Why a Hayward year-end payroll checklist matters more this year
Year-end payroll for 2026 is not a copy of last year. Three federal changes affect almost every small employer:
- Higher 1099 threshold. For payments made in 2026, Form 1099-NEC is generally required when you pay a nonemployee $2,000 or more for services, up from $600. The threshold is set to be adjusted for inflation after 2026. See the IRS page Am I required to file a Form 1099?.
- New W-2 boxes. The 2026 Form W-2 adds Box 12 codes for tips, qualified overtime, and Trump account contributions, and splits Box 14 in two.
- New e-file system for 1099s. The IRS FIRE system takes its last information returns on November 19, 2026. After January 1, 2027, the IRS Information Returns Intake System (IRIS) is the only IRS system for e-filing information returns.
Key dates for Hayward employers:
- November 2, 2026: third-quarter 2026 Form 941 (October 31 is a Saturday; November 10 if you deposited all taxes on time). The Q3 2026 DE 9 and DE 9C are delinquent if not filed by November 2, 2026.
- February 1, 2027: Forms W-2 to employees and to the SSA, Forms 1099-NEC to recipients and the IRS, Q4 2026 Form 941, and Form 940. January 31, 2027 is a Sunday, so these move to Monday. If you deposited all Form 941 or Form 940 tax on time, you may file that return by February 10, 2027.
- February 1, 2027: the Q4 2026 DE 9 and DE 9C are delinquent if not filed by this date, according to the EDD payroll tax due dates calendar.
Step 1: Clean up employee records in October and November
Most W-2 rejections and corrections trace back to bad master data. Before the holidays:
- Match names and Social Security numbers to each employee’s Social Security card. The SSA’s free Social Security Number Verification Service lets registered employers check them.
- Confirm mailing addresses and electronic-delivery consent for anyone receiving a W-2 by email or portal.
- Reconcile year-to-date payroll registers to the Forms 941 and DE 9 you filed for Q1 through Q3. Differences are much easier to fix now than after W-2s go out.
- Flag former employees. You may give a departing employee a W-2 any time after employment ends, but no later than February 1, 2027. If they ask for it, the IRS gives you 30 days from the request or the final wage payment, whichever is later.
- Remind staff to review Form W-4 and California Form DE 4 if their family or income situation changed, so 2027 withholding starts out right.

Step 2: Report tips, overtime, and fringe benefits correctly on 2026 W-2s
The 2026 General Instructions for Forms W-2 and W-3 add reporting tied to the new federal deductions for tips and overtime. Hayward restaurants, salons, auto shops, and logistics businesses with hourly crews will feel this most.
Tips
Employees must report tips of $20 or more in a month to you, and those tips are still subject to income tax withholding and Social Security and Medicare tax. On the 2026 W-2, report total cash tips reported to you in Box 12, code TP, and enter the employee’s Treasury Tipped Occupation Code(s) in the new Box 14b. Qualified overtime
Box 12, code TT reports qualified overtime compensation: only the premium portion (the “half” of time-and-a-half) that the federal Fair Labor Standards Act requires, generally for hours over 40 in a workweek. California daily overtime and double time that federal law does not require are not FLSA-required overtime, so set up separate earning codes now rather than trying to split them in January. Overtime is still fully subject to payroll taxes.
Wage bases and fringe benefits
- The 2026 Social Security wage base is $184,500, so employee Social Security tax should stop at $11,439. Medicare has no cap, and the 0.9% Additional Medicare Tax applies once an employee’s wages pass $200,000.
- California SDI withholding is 1.3% of all wages for 2026 with no wage ceiling. UI and ETT apply to the first $7,000 per employee; see EDD contribution rates.
- Add taxable fringe benefits before the final payroll: personal use of company vehicles, gift cards and other cash equivalents, and health insurance premiums for 2% S corporation shareholder-employees.
Step 3: Contractors, W-9s, and the new $2,000 Form 1099-NEC threshold
Contractor reporting is where most small Hayward businesses lose time in January. Use the rest of Q4 to:
- Collect a Form W-9 from every contractor now, ideally before you issue the final 2026 payment. The IRS Form W-9 gives you the legal name, tax classification, and TIN you need. If a payee will not give you a TIN, backup withholding at 24% can apply.
- Total 2026 payments by payee and mark who crosses $2,000 for services. Parts and materials billed as part of a service count toward the total.
- Remember the exceptions. Payments to most corporations are not reported, but attorney and legal-services payments are reportable even when the firm is a corporation. Card and app payments (credit cards, PayPal, and similar networks) are reported by the processor on Form 1099-K, not by you on a 1099-NEC.
- Review worker classification. California’s ABC test is stricter than the federal standard. A worker who looks like a contractor under IRS rules can still be an employee under state law.
California adds its own step. The EDD independent contractor reporting rules require a Report of Independent Contractor(s) (DE 542) within 20 calendar days when you must file a federal 1099-NEC or 1099-MISC for an individual, sole proprietor, or single-member LLC and you pay, or contract to pay, $600 or more. EDD lists a $24 penalty per late report ($490 if intentional). The federal and state numbers no longer line up, so confirm how this applies to contractors you paid between $600 and $2,000.
Step 4: File the federal and California year-end returns on time
- Forms W-2 and W-3: file with the SSA by February 1, 2027, ideally through SSA Business Services Online. BSO sign-in now uses a Login.gov or ID.me credential, so set up access before January. If you file 10 or more information returns in total (W-2s and 1099s combined), you must e-file.
- Forms 1099-NEC: furnish and file by February 1, 2027. If you used FIRE in past years, set up an IRIS Transmitter Control Code before January, or have your CPA or payroll provider file for you.
- Form 941 (Q4) and Form 940: due February 1, 2027 (February 10 if all deposits were timely). California has been a FUTA credit reduction state: for 2025, the credit was cut by 1.2%, adding $84 per employee. EDD expects the reduction to grow by 0.3% a year while the state’s federal loan is unpaid, so budget for a higher 2026 Form 940. See the EDD FUTA page.
- DE 9 and DE 9C: file the Q4 2026 reports through EDD e-Services for Business by February 1, 2027.

Hayward minimum wage and other local rules for 2027
Hayward has its own minimum wage ordinance, and the new rates take effect with your first 2027 payroll. According to the City of Hayward local minimum wage page:
- 2026: $16.90 per hour for employers with 25 or fewer employees; $17.79 for employers with 26 or more.
- January 1, 2027: $17.40 per hour for small employers (matching the new statewide minimum wage) and $18.39 for large employers.
The ordinance covers employees who work at least two hours a week within Hayward city limits, and tips cannot count toward the minimum. Employers must post the city’s annual bulletin at the workplace. Employee counts include people employed outside the city, so a growing business can cross the 26-employee line without noticing.
California’s exempt-salary minimum is tied to twice the state minimum wage for full-time work, which comes to $72,384 a year in 2027. Review salaried managers and office staff before January.
